In 2015, in addition to its case work, the Electronic Retailing Self-Regulation Program (ERSP) worked towards creating greater visibility for the program and continued to seek out new opportunities for advertising self-regulation.
Last year, ERSP attended several events and spoke on webinars, including LeadsCon NY, the Republican Attorneys General Association’s ERC Meeting, Conference of Western Attorneys General, Follow the Lead: An FTC Workshop on Lead Generation, the ERA’s Government Affairs Committee, ERA’s Great Ideas Summit and D2C Convention, and Social Media Week NYC. ERSP also hosted its annual Summit in May, which was highlighted by a one-on-one interview with FTC Commissioner Maureen Ohlhausen and remarks from the Commission’s director of Marketing Practices, Lois Greisman, and John Singer from the Commission’s Division of Enforcement.
ERSP continues to discuss new self-regulatory endeavors with representatives from several industries. With recent regulation of continuity and negative option offers, several ERA members have expressed interest about a self-regulation undertaking to improve consumer and business confidence in advertising and marketing with respect to these offers. Accordingly, ERSP is now working with ERA to develop a program to assist companies within the industry to comply with existing regulations through responsible and meaningful self-regulation in the backend marketing space. Stay tuned for updates on this program as well as other possible developments in the self-regulatory space.
Looking forward, ERSP will be presenting its Year in Review webinar as part of the February 4 ERA Government Affairs Committee call and on February 22, as an ERSP staff member I will be part of a Social Media Week NYC panel entitled, “Honest Ads And Clear Disclosures.” Also on the panel are Laura Brett, assistant director, National Advertising Division (NAD), and Katie Goldstein, senior staff attorney, Children’s Advertising Review Unit (CARU). The panel will be moderated by John P. Feldman, partner, Reed Smith. Also, on February 22, participants of the ERSP Review Program will meet at 1:00 p.m. at The Great Ideas Summit in Orlando to discuss recent developments with the program. In addition, ERSP Director Peter Marinello is scheduled to speak about advertising self-regulation at LeadsCon Las Vegas on March 15.
In May, ERSP will once again host its annual Summit. We anticipate an exciting half-day of panels and discussion so be on the lookout for our save the date email!
