There was a lot of interesting dialogue regarding advertising self-regulation at the ERA D2C Convention in Las Vegas earlier this month. ERSP Director Peter Marinello moderated a Masters Series panel entitled, "D2R - It's Hot and It's Not What You Think." It featured Utah Attorney General Sean Reyes, Venable’s Jeffrey Knowles, Invictus’s Bill Knowlton, and Manatt’s Marc Roth. Among the topics discussed were the increased liability for back-end segments of the direct response marketing practices, the collaboration of state and federal regulatory agencies in investigations of egregious marketing practices, and taking steps to increase the visibility of ERA’s self-regulatory efforts.
ERSP also hosted a meeting of ERA thought leaders regarding the viability of a self-regulatory forum to address ongoing e-commerce issues and finalized the ERSP Review Program Guidance document for Telemarketing & Live Seminar Events.
ERSP Director Peter Marinello was also asked to speak at the Direct Selling Association’s Business and Policy Conference on October 24th in Washington, D.C. He will be on the panel entitled “Income and Lifestyle Claims and Advertising Roundtable: Trends and Guidance,” which will explore the practical application of the DSA’s Code of Ethics, and the legal, regulatory and self-regulatory underpinnings for claims standards related to consumer testimonials, as well as express and implied advertising claims pertaining to income and success. Also featured on the panel will be Jared Blum, the Code Administrator for the Direct Selling Association, Ralph Hummel, a Partner at Avocado Law, and Rich Cleland, Assistant Director, Advertising Practices, Bureau of Consumer Protection, Federal Trade Commission.
